things have gotten a bit trickier now as bush has nominated john roberts as chief justice. i would think that the justices, all of whom have more judicial experience than roberts, would take this as a slap in the face, like a freshman getting a starting job over a returning senior. it is elevation of an associate justice, though, that is the exception; only three justices--white, stone, and rehnquist--were made chief after serving as an associate.
but will conservatives take it as a slap in the face? and what if bush nominates alberto gonzalez to take o'connor's seat?
